Salary disparities between locals & overseas recruits is against law
Salary disparities, between employees in similar jobs in private sector are against the spirit of Labour law, says a leading legal practitioner.
Mohsin Thiyab Al Suwaidi, an Advocate, is of the opinion that although a company is free to provided allowances to its employees on the basis of their performance, atleast, the basic salaries of employees in similar jobs in a firm should remain the same, considering the spirit of labour law.
Yet another Advocate mentioned that, the basic salary of an employee depends on the contract signed with the employer.
According to sources in the Trade and Industry, although salary disparities exist among those in similar jobs in private companies, the emoluments of workers, largely depends on their qualification, experience and performance.
Al Suwaidi, said that while employers do, differentiate, between those being hired locally and those hired from overseas, doing similar jobs, when it comes to allowances, the practice however, should not be encouraged. A person should be given a salary based on his or her qualification, experience and personal circumstances.
In majority of the cases, local recruits are not paid air tickets to return to home countries, and are not given adequate housing allowance, which is a wrong practice. Allowances should depend on the performance of the employee, Al Suwaidi emphasized.
