New sponsorship law highlights
The exit permit system in Doha is likely to be removed as per the new sponsorship regulation, the draft of which has already been published by local dailies yesterday.
As per the draft any working resident women are allowed to sponsor their husbands and children, provided they meet the eligibility criteria.
The draft considers it as illegal for sponsors to retain the passports of their expatriate workers after completion of the visa formalities, unless it is mutually agreed to do between the two parties.
The Minister-in-charge or an authority appointed by him will be given the right to change the sponsorship in case of domestic workers who are abused by their employers.
The draft, however, retains most of the rules currently existing over the stay and work of residents and their families here. For instance, the residents cannot change their sponsorship unless they gain approval from their employers. Else, only the Minister in-charge will have the right to order for a change in sponsorship.
However, the draft also suggests that the Department of Labour can also recommend to the Minister or the concerned authority to change the sponsorship of an expatriate on valid grounds.
Any resident, who resided here on a work visa and left the country on good terms after quitting the job or had been dismissed, can get back for employment purposes with any other company, after a gap of two years. This right to waive this condition, if needed, lies with the minister-in-charge or an authority deputed by him.
The draft also suggests establishment of a new department to take care of the implementation of the new sponsorship law, and to closely monitor the new entry and employment regime.
Both foreign workers and their sponsors who enter the country should complete the residence formalities within seven working days from their date of arrival. Residents can stay out of country for up to a maximum of six months, and then seek an extension for another six months after paying a fee, provided, they own a Residence Permit (RP) which is valid for 60 days during the time of their re-entry.
The draft suggests that residents will have to apply for RP of a newborn within 60 days from their date of birth, even if the place of birth is outside Qatar.
However, one will have to wait and watch whether the new sponsorship law, which is likely to be enforced, will include all the provisions outlined in the draft.
